PFAS Issues Related to Brownfield Redevelopment

PFAS issues are at the forefront of increasing regulatory oversight and action from the USEPA and many if not all of the states. With regard to brownfield redevelopment, it’s not a matter of if, but when, a PFAS issue may arise in connection with a transaction or brownfield redevelopment project.

Does Alabama's Brownfields Law Provide an Effective Shield from Liability?

In a recent decision by the United States Court of Appeals for the 3d Circuit, the Court examined the impact of a settlement or a resolution of a claim by a state upon claims for contribution by other PRPs and claims by the United States EPA under Superfund. This presentation will provide an overview of that decision, a general discussion of Superfund liability and the Alabama Brownfield law, and some strategies to ensure that the liability protection provided by the Alabama Brownfields law acts is an effective liability shield.

Beyond the Single-Grant Approach: A Case Study for Building A Robust and Resilient Brownfield Program

Daryl Hernandez will present an EPA-recognized brownfield case study, Paradise Creek Affordable Housing Development located in National City, California. This brownfields redevelopment project was based on a strategic and holistic approach to maximizing brownfield resources for public and private stakeholders. Daryl will present the strategy used to address the challenges associated with revitalizing a community disproportionately impacted by environmental justice issues, blighted properties, incompatible land uses, and brownfields.

Opportunity Alabama

Alex Flachsbart is President and CEO of Opportunity Alabama, the nation’s first nonprofit organization to create a marketplace for Opportunity Zone investment in a particular state.  He received his B.A. and M.A. in Economics from the University of Alabama before attending Washington & Lee University where he received his Juris Doctorate.  Prior to founding Opportunity Alabama in 2018, Alex was an Associate Attorney at Balch & Bingham in Birmingham.

RENEA HALL, Environmental Engineer

United States Environmental Protection Agency

Renea Hall is an Environmental Engineer at the  US Environmental Protection Agency (EPA), the Region 4 Staff Lead for PFAS Emerging Contaminants, and the Alabama Drinking Water Program Liaison.  Renea received her B.S. in Chemical Engineering from Georgia Tech in 1998 and has been with the EPA since 2011.

John Hollar is a Principal at Geosyntec Consultants providing EHS Compliance and Management, Due Diligence, and Remediation Services.  John is a Registered Professional Engineer and received his B.S. in Civil & Environmental Engineering from Northeastern University in 1991.  Prior to joining Geosyntec in 2017, John was a Partner with Environmental Resources Management in Atlanta.

For almost thirty years, Buddy has represented clients facing a variety of environmental and natural resource problems. His practice involves a variety of regulatory compliance and enforcement matters under federal and state law and environmental and toxic tort litigation in federal and state courts.  Buddy received his B.A. in Economics from Vanderbilt University before attending the University of Virginia Law School where he received his Juris Doctorate.

Daryl Hernandez is an Associate Principal with EnSafe in San Diego, California.  He is a Registered Professional Engineer in California and his specialties include brownfield redevelopment, K-12 new school environmental permitting and assessments, environmental site assessments and investigations, environmental risk management, redevelopment planning, and environmental compliance.  Daryl received his B.S. in Civil Engineering from Cal State Fullerton. Prior to joining EnSafe in 2017, he was Principal Engineer and Founding Partner of E2 ManageTech in Foothill Ranch, California.
